LAGOS/Nigeria: In a unanimous decision handed down by the Court of Appeal in Lagos, Governor Sheriff Oborevwori’s election win for the March 18th polls in Delta State under the banner of the Peoples Democratic Party (PDP) has been affirmed.
The appeal brought forth by the governorship candidate of the All Progressive Congress (APC), Senator Ovie Omo-Agege, was dismissed by the appellate court on the grounds of lacking merit.
This decision echoes the earlier stance taken by the Delta State Governorship Election Petition Tribunal in Asaba, which upheld Oborevwori’s victory on September 29th, amidst legal contentions.
Omo-Agege, the immediate past Deputy President of the Senate, pursued an appeal challenging the Tribunal’s judgment, seeking to be declared the rightful winner of the poll. Conversely, Oborevwori urged the court to dismiss the appeal, arguing its lack of merit.
The Court of Appeal, in its verdict on Friday, upheld Oborevwori’s election and rejected Omo-Agege’s appeal on the basis of lacking merit. Furthermore, it upheld the judgment of the lower Tribunal, solidifying Oborevwori’s position as the victor.
Additionally, the Tribunal, in a separate judgment, dismissed an appeal by Kenneth Gbaji of the Social Democratic Party (SDP) against the PDP, APC, and Labour Party (LP) and their respective governorship candidates.
Likewise, in a distinct ruling, the appellate court dismissed an appeal by the Labour Party (LP) and its governorship candidate, Ken Pela, challenging the lower Tribunal’s decision, which upheld Oborevwori’s election.
